RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-02132 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ _ APPLICANT REQUESTS THAT: His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, reflect medals awarded for his service in Korea. ________________________________________________________________ _ APPLICANT CONTENDS THAT: He is proud of his military service and requests all awards due to him that pertain to each period of war served. In support of the applicant’s appeal, he provides a copy of his DD Form 214, Retirement Order, and a Department of Veterans Affairs Rating Decision. The applicant's complete submission, with attachments, is at Exhibit A. ________________________________________________________________ _ STATEMENT OF FACTS: On 31 January 1973, the applicant retired in the grade of colonel after serving 30 years, 1 month and 24 days of active service for retirement. ________________________________________________________________ _ AIR FORCE EVALUATION: AFPC/DPAPP recommends denial. DPAPP states a review of the applicant’s master personnel records and documentation submitted failed to provide any documents that substantiate foreign service time in Korea. The DPAPP complete evaluation is at Exhibit C. AFPC/DPSID recommends denial. DPSID states the Korean Service Medal (KSM) is awarded to service members who participated in operations in the Korean theater between 27 June 1950 and 27 July 1954. The Korean Defense Service Medal is awarded from 28 July 1954 to a future date to be determined to service members who were assigned, attached, or mobilized to units operating or serving on all the land area of the Republic of Korea, and the contiguous waters out to 12 nautical miles, and all airspace above the stated land and water areas. To be eligible for the Korean Defense Service Medal, personnel must have been physically present in the stated areas for 30 consecutive days or 60 nonconsecutive days. The applicant’s DD Form 214 reflects 9 years, 2 months and 3 days of foreign service. Section 30 (Remarks) of the DD Form 214 reflects Indochina “No”, Vietnam “Yes”, and Korea “No”. AFPC/DPAPP was unable to verify foreign service time in Korea. After a thorough review of the applicant’s record and with assistance from AFPC/DPAPP - they were unable to verify any awards or decorations for service in Korea. Based on DPSID’s review of the applicant’s official military personnel record, they were able to determine the applicant should have been awarded the Vietnam Service Medal with one Silver Service Star (VSM w/1 SSS), Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P); and the Vietnam Campaign Medal during the applicant’s service from 3 November 1943 to 31 January 1973 and were not reflected in his records. Upon final board decision, administrative correction of the applicant’s record will be completed by AFPC/DPSOR. The DPSID complete evaluation is at Exhibit D. ________________________________________________________________ _ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 20 September 2013, copies of the Air Force evaluations were forwarded to the applicant for review and response within 30 days (Exhibit E). As of this date, no response has been received by this office. ________________________________________________________________ _ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. The applicant’s contentions are duly noted; however, after reviewing the evidence of record, we agree with the opinion and recommendations of the Air Force offices of primary responsibility and adopt their rationale as the basis for our conclusion the applicant has not provided sufficient evidence to substantiate time served in Korea or his entitlement to any awards for Korean service.
